Session 5: Sentencing

During the 4th week of my internship at the courthouse, I was placed in the fifth session which focuses on sentencing. When a defendant pleads guilty or is convicted of a crime they can either be sentenced immediately or a later date will be set for a sentencing hearing. Initially, the defendant is informed of the crime and the verdict. Prosection will outline the facts and point out the most significant facts from the case. The defendant has the chance to respond with their background and their circumstances for committing the crime. The judge will take the allegation into consideration and impose a sentence. A sentence may include incarceration, probation, community service, restitution or suspended sentence. The issue of cost will be addressed and waived if necessary. Fees can only be waived if the Judge is in agreement.
